This book addresses the ambiguities of the growing use of private security contractors and provides guidance as to how our expectations about regulating this expanding ‘service’ industry will have to be adjusted. In the warzones of Iraq and Afghanistan many of those who carry weapons are not legally combatants, nor are they protected civilians. They are contracted by governments, businesses, and NGOs to provide armed security. Often mistaken as members of armed forces, they are instead part of a new protean proxy force that works alongside the military in a multitude of shifting roles, and overseen by a matrix of contracts and regulations. This book analyzes the growing industry of these private military and security companies (PMSCs) used in warzones and other high risk areas. PMSCs are the result of a unique combination of circumstances, including a change in the idea of soldiering, insurance industry analyses that require security contractors, and a need for governments to distance themselves from potentially criminal conduct. The book argues that PMSCs are a unique type of organization, combining attributes from worlds of the military, business, and humanitarian organizations. This makes them particularly resistant to oversight. The legal status of these companies and those they employ is also hard to ascertain, which weakens the multiple regulatory tools available. PMSCs also fall between the cracks in ethical debates about their use, seeming to be both justifiable and objectionable. This transformation in military operations is a seemingly irreversible product of more general changes in the relationship between the individual citizen and the state. This book focuses on the problems of, and prospects for, strengthening the global system of security governance in a manner consistent with the aspirations and practices of the EU. The EU approach to security governance has been successful in its immediate neighbourhood: it has successfully exported its preferred norms and principles to applicant countries, thereby 'pacifying' its immediate neighbourhood and making all of Europe more secure. The EU governance orientation ultimately seeks to enlarge the European security community and expand the geopolitical area within which armed conflicts are inconceivable, and where state and private actors converge around a set of norms and rules of behaviour and engagement. The EU's success along its immediate boundaries has not yet been replicated on a global scale; it remains an open question whether the EU system of governance can be exported globally, owing to different normative structures (for example, a tolerance of armed conflict or non-democratic governance internally), great-power competition (such as US--China), or ongoing processes of securitization that has made it difficult to find a commonly accepted definition of security. Moreover, the EU system of security governance clashes with the continuing unwillingness of other major powers to cede or pool sovereignty as well as varying preferences for unilateral as opposed to multilateral forms of statecraft. This edited volume addresses both the practical and political aspects of security governance and the barriers to the globalization of the EU system of security governance, particularly in the multipolar post-Cold War era. This book examines the emergence of new international norms to govern the spread of small arms, and the extent to which these norms have been established in the policies and practices of states, regions and international organizations. It also attempts to establish criteria for assessing norm emergence, and to assess the process of norm development by comparing what actually happens at the multilateral level. If norm-making on small arms and related multilateral negotiations have mostly dealt with ‘illicit arms’, and most of the norms examined here fall on the arms supplier side of the arms equation, the author argues that the creation of international norms and the setting of widely agreed standards amongst states on all aspects of the demand for, availability, and spread of both legal and illegal small arms and light weapons must become central to the multilateral coordination of policy responses in order to tackle the growing violence associated with small arms availability.
